1. INTRODUCTION AND ACCEPTANCE OF TERMS

Welcome to Vitamin CHE (the "App"), owned and operated by Elena Chemezova, a sole proprietor registered under the laws of the Republic of Kazakhstan (Business Identification Number: 7908300050270).

By downloading, installing, accessing, or using the Vitamin CHE mobile application, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the App.

YOU ACKNOWLEDGE AND AGREE THAT:

  • NO DOCTOR-PATIENT RELATIONSHIP: Use of this App does not create a physician-patient, therapist-client, or any other healthcare professional relationship.
  • NOT A SUBSTITUTE FOR PROFESSIONAL CARE: The information provided is NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or qualified healthcare provider with any questions regarding a medical condition.
  • EMERGENCY SITUATIONS: If you are experiencing a medical emergency, call emergency services immediately (911 in the US/Canada, 112 in EU, or your local emergency number). DO NOT rely on this App for emergency medical assistance.
  • INDIVIDUAL MEDICAL HISTORY: The App cannot and does not account for your individual medical history, current medications, allergies, pre-existing conditions, or unique physiological characteristics.

All content within the App, including but not limited to:

  • Vitamin, mineral, and dietary supplement information
  • Compatibility tables and interaction data
  • Dosage references
  • Health benefit descriptions
  • Product recommendations

2.3 Consult Healthcare Professionals

BEFORE starting, stopping, or modifying any vitamin, supplement, or medication regimen, you MUST consult with a licensed healthcare professional. This is particularly critical if you:

  • Have pre-existing medical conditions
  • Are taking prescription medications
  • Have known allergies or sensitivities
  • Are under 18 years of age

3.1 Core Features

The Vitamin CHE App provides:

a) Reference Directory: A comprehensive database of vitamins, minerals, and dietary supplements (BAS - Biologically Active Supplements) including:

  • Nutritional information
  • Potential health benefits
  • Recommended daily allowances
  • Common sources

b) Compatibility Table: A research-based tool that provides general information about potential interactions between vitamins, minerals, and supplements. RESULTS ARE GENERALIZED AND DO NOT ACCOUNT FOR INDIVIDUAL MEDICAL CIRCUMSTANCES.

c) Product Recommendations: Curated lists and "TOP 10" rankings of supplement products based on:

  • Editorial research
  • Quality assessments
  • User reviews
  • Industry reputation

IMPORTANT: These rankings are NOT paid advertisements and represent independent editorial assessments. However, the App may earn affiliate commissions from purchases (see Section 4).

d) AI Consultant (Experimental Feature): An automated information retrieval system powered by artificial intelligence algorithms. This feature:

  • Is experimental and in continuous development
  • May produce inaccurate, incomplete, or misleading information ("hallucinations")
  • Should be independently verified through professional sources
  • Does NOT constitute professional medical advice

3.2 Third-Party Marketplace Integration

The App provides links to third-party e-commerce platforms (including but not limited to iHerb) where users may purchase vitamins and supplements. The Owner:

  • Does NOT sell products directly
  • Is NOT responsible for product quality, safety, delivery, or customer service
  • Does NOT guarantee product availability or pricing accuracy
  • Has NO control over third-party return policies or dispute resolution

4. AFFILIATE DISCLOSURE AND MONETIZATION

4.1 Affiliate Relationships

TRANSPARENCY NOTICE: Vitamin CHE participates in affiliate marketing programs and earns commissions when users make purchases through affiliate links within the App.

Affiliate Partners Include (but are not limited to):

  • iHerb Affiliate Program
  • Other supplement retailers and marketplaces

4.2 Editorial Independence

While the App earns affiliate commissions, our product recommendations and ratings are based on independent editorial research and analysis. Rankings are NOT determined by:

  • Commission rates
  • Paid placements
  • Advertising fees
  • Sponsored content

4.3 User Disclosure

When you click on an affiliate link and make a purchase, the Owner receives a commission at no additional cost to you. Product prices remain the same whether accessed through the App or directly through the retailer.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Ownership

All content, features, functionality, design elements, software, databases, text, graphics, logos, icons, and trademarks within the App are the exclusive property of Elena Chemezova or licensed third parties and are protected by:

6. USER CONDUCT AND PROHIBITED ACTIVITIES

You agree NOT to:

a) Misuse Medical Information: Use the App as a replacement for professional medical care or advice.

b) Illegal Activities: Use the App for any unlawful purpose or in violation of applicable laws.

c) Harmful Actions:

  • Transmit viruses, malware, or harmful code
  • Interfere with App security features
  • Attempt unauthorized access to systems or data

d) False Information: Provide false, misleading, or fraudulent information during registration or use.

e) Harassment: Engage in abusive, threatening, or harassing behavior toward other users or the Owner.

f) Commercial Exploitation: Use the App for unauthorized commercial purposes, including reselling information or competing services.

7. PRIVACY AND DATA PROTECTION

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy details:

  • Your rights under GDPR, CCPA, and PIPEDA

8. LIMITATION OF LIABILITY

8.1 MAXIMUM LEGAL EXTENT

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ELENA CHEMEZOVA AND VITAMIN CHE SHALL NOT BE LIABLE FOR ANY:

a) Indirect, Incidental, Consequential, or Punitive Damages including but not limited to:

  • Loss of profits or revenue
  • Loss of data or business opportunities
  • Personal injury or health complications
  • Medical expenses or treatment costs

b) Direct Damages exceeding the amount paid by you to use the App in the twelve (12) months preceding the claim (if any).

8.2 Health-Related Liability

⚠️ CRITICAL: THE OWNER IS NOT LIABLE FOR ANY HEALTH CONSEQUENCES, ADVERSE REACTIONS, DRUG INTERACTIONS, ALLERGIC RESPONSES, OR MEDICAL COMPLICATIONS ARISING FROM:

  • Reliance on App information
  • Use of recommended products
  • Decisions made based on the Compatibility Table
  • Inaccuracies in AI Consultant responses
  • Failure to consult healthcare professionals

8.3 Third-Party Liability

The Owner is NOT responsible for:

  • Product quality, safety, or efficacy from third-party retailers
  • Shipping delays, lost packages, or delivery issues
  • Customer service disputes with affiliate partners
  • Defective products or mislabeling
  • Changes to third-party websites or availability

8.4 AI System Limitations

THE AI CONSULTANT FEATURE IS EXPERIMENTAL. The Owner is NOT liable for:

  • Algorithmic errors or "hallucinations"
  • Incomplete or outdated information
  • Misinterpretation of user queries
  • Technical malfunctions or data processing errors

9. DISCLAIMER OF WARRANTIES

9.1 "AS IS" AND "AS AVAILABLE" BASIS

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability: Fitness for a particular purpose
  • Accuracy: Completeness or reliability of content
  • Non-Infringement: Freedom from third-party rights violations
  • Uninterrupted Service: Continuous, error-free, or secure operation
  • Timeliness: Currency of information or real-time updates

9.2 Information Accuracy

While we strive for accuracy, we do NOT warrant that:

  • App content is current, complete, or error-free
  • Research data is exhaustive or definitive
  • Product information reflects latest formulations or labeling
  • AI-generated responses are accurate or reliable

9.3 No Professional Endorsement

References to specific products, brands, or manufacturers do NOT constitute:

  • Medical endorsement by healthcare professionals
  • Safety guarantees or quality certifications
  • Recommendations for specific individuals or conditions

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Elena Chemezova, Vitamin CHE, and their affiliates, contractors, licensors, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

a) Your violation of these Terms b) Your misuse of the App or its content c) Your violation of any third-party rights d) Health consequences from decisions made using App information e) Disputes with third-party retailers or service providers f) Any false or misleading information you provide


11. MODIFICATIONS TO THE APP AND TERMS

11.1 App Changes

The Owner reserves the right to:

  • Modify, suspend, or discontinue any App feature at any time
  • Update product databases and information
  • Change affiliate partnerships
  • Implement new AI algorithms or data sources

WITHOUT prior notice or liability.

11.2 Terms Updates

These Terms may be updated periodically. Changes become effective upon posting within the App. Continued use after modifications constitutes acceptance of revised Terms.

Material changes will be communicated via:

  • In-app notifications
  • Email to registered users
  • Website posting at the official Vitamin CHE website

12. TERMINATION

12.1 User Termination

You may terminate your use of the App at any time by:

  • Uninstalling the App from all devices
  • Requesting account deletion via elena@chemezova.com

12.2 Owner Termination

The Owner may terminate or suspend your access immediately, without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abusive conduct
  • Any reason at the Owner's sole discretion

12.3 Effect of Termination

Upon termination:

  • Your license to use the App ends immediately
  • You must cease all use and delete the App
  • Sections 2, 5, 8, 9, 10, 13, and 14 survive termination

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1 Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict of law principles.

13.2 International Users

For users in specific jurisdictions, the following additional laws apply:

  • European Union: GDPR and EU consumer protection directives
  • United States: FTC Act, CCPA (California residents)
  • Canada: PIPEDA and provincial consumer protection laws
  • United Kingdom: UK GDPR and Consumer Rights Act 2015

13.3 Dispute Resolution

Informal Resolution: Before initiating legal action, parties agree to attempt good-faith negotiations by contacting elena@chemezova.com.

Arbitration (Where Applicable): Disputes may be resolved through binding arbitration in accordance with Kazakhstan commercial arbitration rules, except where prohibited by mandatory consumer protection laws.

Jurisdiction: Courts of the Republic of Kazakhstan shall have jurisdiction, subject to mandatory local jurisdiction rules for consumer contracts.

13.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS.

14. MISCELLANEOUS PROVISIONS

14.1 Entire Agreement

These Terms, together with the Privacy Policy, Data Processing Agreement, Cookie Policy, and Disclaimer, constitute the entire agreement between you and the Owner.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

14.3 No Waiver

Failure to enforce any right or provision does not constitute a waiver of such right.

14.4 Assignment

You may not assign or transfer these Terms. The Owner may assign these Terms without restriction.

14.5 Force Majeure

The Owner is not liable for failures or delays caused by circumstances beyond reasonable control (natural disasters, pandemics, government actions, etc.).

14.6 Language

These Terms are drafted in English. Translations are provided for convenience only; the English version controls in case of conflicts.

15. ACKNOWLEDGMENT AND CONSENT

BY USING THE VITAMIN CHE APP, YOU ACKNOWLEDGE THAT:
